Welcome to the Elder Millennial Lesbian Bestie website (“EMLB,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of eldermillenniallesbianbestie.com and its related pages, content, event calendar, forms, online shop, social-media links, and other services (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who we are

Elder Millennial Lesbian Bestie is a community-centered platform featuring WLW-inclusive events, creator content, merchandise, and opportunities for connection, with a focus on the St. Louis area.

For purposes of these Terms, the Site is operated by Bestie Creative Co., LLC dba Elder Millennial Lesbian Bestie, located inSt. Louis, MO. You can contact us at beth@eldermillenniallesbianbestie.com.

2. Eligibility and use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in a way that violates applicable law or infringes another person’s rights.

  • Harass, threaten, discriminate against, or abuse any person or community.

  • Attempt to interfere with Site security, functionality, servers, or networks.

  • Scrape, copy, reproduce, distribute, sell, or exploit Site content without written permission, except as allowed by law.

  • Submit false, misleading, defamatory, unlawful, or unauthorized content.

  • Use the Site to collect personal information about others without their permission.

  • Impersonate EMLB, an event organizer, a business, or another person.

We may suspend, restrict, or terminate access to the Site for conduct we believe violates these Terms or harms the community, Site, or others.

3. Event calendar disclaimer

The Site may list third-party events, venues, organizers, businesses, ticketing platforms, and community activities. Calendar listings are provided for general informational and discovery purposes only.

Unless we expressly state otherwise in writing:

  • EMLB does not organize, host, sponsor, operate, supervise, endorse, verify, or control third-party events.

  • Event information—including date, time, venue, admission price, age restrictions, accessibility, safety practices, availability, and cancellation status—may change without notice.

  • You are responsible for confirming all details directly with the event organizer, venue, or ticket seller before attending.

  • Attendance is voluntary and at your own risk.

EMLB is not responsible for any injury, loss, damage, dispute, cancellation, refund issue, conduct, accessibility issue, or other matter arising from a third-party event, venue, organizer, attendee, ticket seller, or service provider.

4. Event submissions

If you submit an event, image, flyer, description, social-media handle, link, or other material to us (“Submission”), you represent and warrant that:

  • You have the right and authority to submit the material.

  • The Submission is accurate, current, and not misleading.

  • The Submission does not infringe intellectual-property, privacy, publicity, or other rights of another person.

  • You have obtained any necessary permissions, releases, or approvals for photos, graphics, logos, names, and other materials you provide.

Submitting an event does not guarantee publication. We may review, edit for clarity or length, decline, remove, categorize, or update a listing at our discretion. We may also request additional information before publishing.

By submitting material, you grant EMLB a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, adapt, publish, distribute, and promote the Submission in connection with operating and promoting the Site, event calendar, EMLB social channels, and related services. This license continues until you request removal in writing, subject to reasonable time for processing and any copies that may remain in backups, cached pages, or previously published promotional materials.

5. Community standards

EMLB is intended to be a welcoming, community-centered space. We expect Site users, submitters, organizers, and partners to treat others with respect.

We may decline or remove content, listings, comments, or submissions that we reasonably believe involve:

  • Hate, harassment, threats, discrimination, or dehumanizing conduct.

  • Content that targets people based on sexual orientation, gender identity or expression, race, ethnicity, religion, disability, nationality, or other protected characteristics.

  • Sexual exploitation, non-consensual content, or content involving minors in an inappropriate manner.

  • Fraud, scams, misleading promotions, or unlawful activity.

  • Materially unsafe, exploitative, or deceptive event practices.

  • Content that conflicts with the purpose, safety, or community values of the Site.

This right does not create an obligation for EMLB to monitor all content or events.

6. Shop purchases

If you purchase merchandise or other products through the Site, additional terms, product descriptions, shipping terms, return/refund policies, and checkout-provider terms may apply.

You agree to provide accurate order, billing, shipping, and payment information. We may refuse, limit, cancel, or refund orders in our discretion, including where an item is unavailable, a price or listing error occurred, we suspect fraud, or the order violates these Terms.

Product colors and appearance may vary due to device displays, production methods, and photography. Please review the applicable product page and [Shipping Policy] and [Return/Exchange Policy] before purchase.

7. Third-party services and links

The Site may link to or embed content from third parties, including TikTok, Instagram, Google Calendar, Tockify, ticketing platforms, maps, payment processors, online storefronts, event organizers, and social-media platforms.

Third-party websites, events, products, services, content, and policies are not under our control. Your use of them is governed by their own terms, policies, and practices. EMLB does not warrant or assume responsibility for third-party content, availability, transactions, data practices, or conduct.

8. Intellectual property

The Site and its original content—including branding, logo, design, copy, graphics, photographs, videos, text, layouts, merchandise designs, and other materials—are owned by or licensed to EMLB and are protected by applicable intellectual-property laws.

You may view and share Site content for personal, non-commercial purposes, provided you do not remove attribution or imply endorsement. You may not reproduce, modify, republish, distribute, create derivative works from, sell, license, or commercially exploit Site content without our prior written consent.

Third-party names, logos, photos, and marks remain the property of their respective owners.

9. Creator content and collaborations

Creator content, opinions, recommendations, and community commentary on the Site or linked social-media channels are for general informational and entertainment purposes. Unless otherwise identified, they are not professional legal, medical, mental-health, financial, or safety advice.

Sponsored, gifted, affiliate, or paid promotional content will be identified when required by applicable law and platform rules. Brand partners are responsible for the accuracy and legality of their products, services, and claims.

10. No warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, EMLB disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, availability, and uninterrupted operation.

We do not guarantee that the Site, calendar, forms, shop, links, or embedded third-party services will always be available, error-free, complete, current, or secure.

11. Limitation of liability

To the fullest extent permitted by law, EMLB and its owners, officers, employees, contractors, partners, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising out of or related to your use of—or inability to use—the Site, an event listing, a third-party event, a third-party service, or any purchase.

To the fullest extent permitted by law, EMLB’s total liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of:

  1. The amount you paid directly to EMLB for the specific product or service giving rise to the claim during the 12 months before the claim arose; or

  2. $100.

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some of these limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless EMLB and its owners, officers, employees, contractors, partners, and agents from claims, liabilities, damages, losses, costs, and expenses—including reasonable attorneys’ fees—arising from or related to:

  • Your use of the Site.

  • Your Submissions or event listings.

  • Your violation of these Terms.

  • Your violation of applicable law or another person’s rights.

  • Your conduct at any third-party event.

13. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we may collect, use, store, and disclose personal information. By using the Site, you acknowledge that you have reviewed the Privacy Policy.

14. Changes to the Site or Terms

We may modify, suspend, discontinue, or update any part of the Site at any time. We may also update these Terms from time to time. The “Last Updated” date above will show when changes were made.

Your continued use of the Site after updated Terms are posted means you accept the revised Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the City of St. Louis, Missouri, and you consent to that jurisdiction and venue.

16. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
